1. Introduction and Acceptance

Welcome to Faithful Growing (“The Company,” “we,” “our,” or “us”). We operate a plant nursery and online store at www.faithfulgrowing.co.za (the “Website” or “Service”).

These Terms & Conditions, together with our Privacy Policy and Returns Policy (collectively, the “Agreements”), govern your access to and use of our Website and the purchase of products from us.

• • Acceptance: By accessing, browsing, or placing an order through our Website, you acknowledge that you have read, understood, and agree to be bound by these Agreements.
  • Compliance: If you do not agree with (or cannot comply with) the Agreements, you may not use the Service.
  • Target Audience: Our Service is intended for use by individuals who are at least eighteen (18) years old. By using the Service, you confirm you are 18 years or older and have the full capacity to enter into this agreement.

2. Online Product Sales and Orders

2.1 Product Descriptions and Appearance

• • Images as Guidance: All images, colours, and product depictions on the Website are for guidance only. We make every effort to display them accurately, but we cannot guarantee that your device’s display will be accurate.
  • Nature’s Uniqueness: You acknowledge and accept that every plant is unique. Variations in shape, size, and colour will occur depending on the season, age, and immediate growing environment. No two plants are identical.
  • Specimen Condition: We select and check every specimen to ensure you receive great quality, healthy plants. However, plants are living things and may arrive with minor wilting, blemishes, or minor damages due to transportation.
  • Size Variation: While we aim for the stated lengths for cuttings, you accept a reasonable variance above or below the stated value is possible due to natural growth and harvesting.

2.2 Pricing and Payment

All prices are listed in South African Rand (ZAR). As we are not VAT-registered, our prices do not include VAT, and no VAT will be charged on any purchase.

• • Prices and Changes: Product prices may change at any time without prior notice.
  • Order Acceptance: We reserve the right to refuse or cancel any order at any time for reasons including but not limited to: product availability, errors in product description or pricing, errors in your order, or suspicion of fraud or an unauthorized transaction.
  • Payment Information: You agree to provide accurate, complete, and up-to-date purchase, billing, and shipping details. You confirm that you are authorised to use the payment method provided.
  • Third-Party Payment: We may use third-party services to facilitate payment and complete purchases, and by submitting your information, you consent to us the right to provide that information to them, subject to our Privacy Policy.

3. Packaging, Delivery, and Risk

3.1 Packaging & Dispatch

We take great care to ensure your plants are packaged safely and sustainably.

• • Cuttings or plants are freshly prepared and cleaned by hand.
  • Dispatch Schedule: We typically send out orders on Monday’s.

3.2 Delivery Details

• • Delivery Area: We offer nationwide delivery, but we do not deliver to PO Boxes or remote rural areas (such as farms) that are not on our logistics partner’s usual routes. If you are unsure, please contact us before placing your order.
  • Delivery Timing: As a general rule, you can expect your parcel to arrive within 2 to 5 working days after the next dispatch date.
  • Delays: While rare, delays can occur, especially in towns further off the main routes. If your parcel does not arrive by Friday, it will generally arrive early the following week (usually Monday).
  • Tracking: We will email or WhatsApp you with Tracking Details once your parcel is with our logistics partner so you can conveniently track its progress.

3.3 Receipt of Parcel and Your Responsibility

• • Signature Required: Deliveries are made mostly between 08:00 and 17:00 (Monday to Friday), and a person must be present at the Shipping Address you provided to sign for and receive the parcel.
  • Accurate Information: You are responsible for ensuring the correct recipient’s name, surname, and contact number are provided. The delivery service often calls the recipient shortly before delivery.
  • Failure to Deliver: We cannot be held responsible for failure to deliver orders if we or our delivery partners cannot get hold of the designated recipient or if an incorrect address was provided.
  • Risk: The risk of damage to or loss of the product passes to you upon delivery or when the goods are tendered for delivery.

4. Returns, Refunds, and Customer Responsibility

4.1 Refunds and Replacements

• • Because our products are living plants, we cannot offer refunds for reasons such as change of mind, natural variation, or plant loss due to incorrect care or environmental factors.

• • Damaged Plants: If your order arrives in poor or damaged condition, please contact us within 24 hours of receiving your parcel at info@faithfulgrowing.co.za with clear photos of the issue. We will assess the situation and work with you to find a fair solution, which may include a replacement or partial refund.
  • Return shipping cost: If applicable will be at the buyer’s expense.

4.2 Customer Responsibility

• • Plant Care: You accept that the ongoing success, growth, and survival of the plants you purchase is your sole responsibility from the moment of receipt.
  • External Factors: We cannot take responsibility for lack of success due to factors beyond our control, including, but not limited to:
    • Poor weather conditions or harsh growing environments.
    • Local pests or diseases in your area.
    • Mistakes made by the customer in planting, watering, or general care.
  • Required Research: Our product pages are not intended to provide the full extent of all horticultural information. By purchasing, you assume you have done your own research and are satisfied with the information available on your chosen plants.

5. Website Use, Accounts, and Intellectual Property

5.1 User Accounts

• • Accuracy: When you create an account, you guarantee that you are over 18 and that the information you provide is accurate, complete, and current at all times.
  • Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must notify us immediately of any security breach or unauthorized use.
  • Termination: We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including for a breach of these Terms.

5.2 Intellectual Property

• • Ownership: The Service and its original content (excluding content provided by users), features, and functionality remain the exclusive property of Faithful Growing and its licensors.
  • Restrictions: Content found on or through the Service may not be distributed, modified, transmitted, reused, downloaded, reposted, copied, or used for commercial purposes or personal gain without express written permission from us.

You agree not to use the Service:

THE SERVICE, INCLUDING ALL PRODUCTS AND SERVICES PROVIDED BY FAITHFUL GROWING, ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

FAITHFUL GROWING MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION AND CONTENT INCLUDED THEREIN.

YOUR USE OF THE SERVICE, ITS CONTENT, AND ANY PRODUCTS OBTAINED FROM US IS AT YOUR SOLE RISK.

WE DO NOT WARRANT THAT:

• • The Service will be uninterrupted, timely, secure, or error-free.
  • The products, services, or information obtained will meet your expectations.
  • The results obtained from the use of the Service or products will be accurate or reliable, as results are dependent on external factors and user actions.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE SOUTH AFRICAN LAW.

6.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY SOUTH AFRICAN LAW:

FAITHFUL GROWING SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, including, without limitation, lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any products procured.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCTS AND/OR SERVICES WHICH ARE THE SUBJECT OF THE CLAIM.

7. General Clauses

7.1 Governing Law and Jurisdiction

These Terms & Conditions are governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the South African courts.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post the amended terms on the Website. It is your responsibility to review these Terms periodically. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
